1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you and Grachtlicht Media B.V., a company registered in the Netherlands under Company No. 78412096 with registered office at Keizersgracht 412, 1016 GC Amsterdam, Netherlands ("we", "us", "the Company"), governing your access to and use of the website cleverpocketscoutshelves.lol and all content published on it (together, the "Site"). By accessing, browsing or otherwise using the Site you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, you must stop using the Site.

2. Definitions

"Content" means all text, editorial articles, hotel profiles, photographs, illustrations, data tables, layouts, source code, typography choices, trade marks and other material made available on the Site. "User" means any person accessing the Site. "Third-Party Property" means any hotel, restaurant, museum, transport operator or other business described on or linked from the Site.

3. Nature of the service

The Site is an independent editorial publication. We describe five luxury hotels located in Amsterdam, together with related guides on geography, room selection, dining and transfers. We are not a travel agent, tour operator, reservation system, booking intermediary, payment processor or insurer. We do not form part of any hotel group, we hold no inventory, we accept no reservations and we take no commission on any stay you may subsequently book.

All rates, room counts, facility descriptions, opening hours, awards and distances published on the Site are indicative, are drawn from publicly available information at the time of writing, and are subject to change without notice by the Third-Party Property concerned. You must verify all material details directly with the relevant property before making a booking or travel commitment.

4. User obligations

You agree to use the Site lawfully, responsibly and in accordance with these Terms. In particular, you agree that you will not:

• use the Site for any unlawful, fraudulent or deceptive purpose, or in breach of Dutch, EU or other applicable law;
• copy, reproduce, republish, scrape, harvest, mirror, frame or systematically extract Content except as permitted in clause 5;
• use automated tools, crawlers, bots or artificial intelligence training pipelines to collect Content without our prior written permission;
• attempt to gain unauthorised access to the Site, its hosting infrastructure, administrative interfaces or any connected system;
• introduce viruses, malware, logic bombs or other harmful code, or conduct denial-of-service or load-testing activity;
• impersonate the Company, its editors or any Third-Party Property, or misrepresent an affiliation that does not exist;
• submit false, misleading, defamatory, abusive, obscene or discriminatory material through the contact form or by email;
• interfere with the operation of the Site, remove copyright notices, or circumvent any technical restriction.

You are responsible for the security of the device and network you use to access the Site, and for all activity conducted from them.

5. Intellectual property rights

All Content is owned by the Company or licensed to it and is protected by Dutch and international copyright, database and trade mark law. Photographic material is used under the licence terms of its respective providers. The Company's name, logo mark and site design are protected as unregistered trade marks and design elements.

You may view Content on screen, print or download a single copy of individual pages for your own personal, non-commercial travel planning, and quote short extracts of up to 60 words provided you attribute the quotation to cleverpocketscoutshelves.lol and include a functioning hyperlink to the original page. All other use — including commercial reproduction, bulk republication, inclusion in a dataset or training corpus, translation, or creation of derivative works — requires our prior written consent. Requests should be sent to [email protected].

6. Your submissions

If you send us an enquiry, correction, tip or other communication, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, reproduce and adapt it for the purposes of responding to you and, where relevant, improving the accuracy of our editorial Content. You confirm that any submission is your own, is accurate to the best of your knowledge, and does not infringe the rights of any third party. We are not obliged to publish, act upon or retain any submission and may remove or decline material at our sole discretion.

7. Third-party links and embedded services

The Site links to official hotel websites, the MICHELIN Guide, museums, railway and airport operators, UNESCO and municipal information sources, and embeds a Google Maps frame on the contact page. These resources are provided for convenience only. We do not control them, do not endorse their content, and accept no responsibility for their availability, accuracy, security or privacy practices. Your use of any third-party service is governed exclusively by that party's own terms and privacy policy.

8. Disclaimers

The Site and all Content are provided "as is" and "as available". To the maximum extent permitted by law we exclude all warranties, conditions and representations, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness or non-infringement. We do not warrant that the Site will be uninterrupted, timely, error-free or free from harmful components, or that defects will be corrected.

Nothing on the Site constitutes professional travel, financial, legal, medical or accessibility advice. Editorial opinions are the views of our editors at the time of publication. Hotel rates, room categories, restaurant awards, opening hours and transport timings change frequently and may be out of date by the time you read them.

9. Limitation of liability

To the fullest extent permitted by applicable law, the Company, its directors, employees and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profit, revenue, business, goodwill, data, anticipated savings, or costs of substitute services, arising out of or in connection with your use of or inability to use the Site, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damage.

Our total aggregate liability arising out of or relating to the Site, howsoever caused, shall not exceed one hundred euros (€100) or, where a higher mandatory minimum applies under Dutch consumer law, the lowest amount permitted by that law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Because the Site is provided free of charge and contains no booking function, we accept no liability whatsoever for any reservation, cancellation, overbooking, rate change, service failure, injury or loss occurring at or in connection with any Third-Party Property.

10. Indemnity

You agree to indemnify and hold harmless the Company and its personnel from and against all claims, liabilities, damages, losses, costs and reasonable legal fees arising from your breach of these Terms, your unlawful use of the Site, or any infringement by you of the rights of a third party.

11. Termination and suspension

We may, at our sole discretion and without prior notice, suspend, restrict or terminate your access to the Site, in whole or in part, where we reasonably believe you have breached these Terms, where your activity threatens the security or performance of the Site, or where required by law or a competent authority. We may also modify, suspend or discontinue the Site or any part of it, including individual pages or articles, at any time. You may terminate this agreement at any time by ceasing to use the Site. Clauses 5, 6, 8, 9, 10, 13, 14 and 15 survive termination.

12. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, flood, fire, war, civil unrest, strike, epidemic, government action, failure of telecommunications networks, power outage, hosting provider failure or malicious cyber attack.

13. Governing law

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation, including non-contractual disputes, are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Where you are a consumer resident in another EEA member state, you retain the benefit of any mandatory consumer protection provisions of your country of habitual residence.

14. Dispute resolution

We would prefer to resolve any complaint directly. Please write in the first instance to [email protected] with a clear description of the issue; we aim to acknowledge within five working days and to propose a resolution within thirty days. If the matter remains unresolved, both parties agree to consider, in good faith, mediation before an accredited mediator in Amsterdam before commencing proceedings.

Failing resolution, the courts of Amsterdam, the Netherlands, shall have exclusive jurisdiction, save that a consumer may also bring proceedings in the courts of their country of residence where mandatory law so provides. Consumers resident in the European Union may additionally use the European Commission's online dispute resolution platform. Claims must be brought within one year of the event giving rise to them, except where a longer period is mandated by law.

15. General provisions

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Company regarding the Site and supersede any prior understanding. If any provision is held invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force. Our failure to enforce a right does not constitute a waiver of it. You may not assign your rights under these Terms; we may assign ours to a successor in connection with a merger, acquisition or reorganisation. We may amend these Terms from time to time by publishing a revised version with an updated effective date; continued use of the Site thereafter constitutes acceptance. These Terms are drafted in English, which is the authoritative language in the event of any translation discrepancy.
